Draft Rule 1101

The Butte County Air Quality Management District (District) is drafting an amendment to Rule 1101 – Title V – Federal Operating Permits to remove the affirmative defense provision from the rule. The United States Environmental Protection Agency (EPA) published a final rule (Removal of Title V Emergency Affirmative Defense Provisions From State Operating Permit Programs and Federal Operating Permit Program), effective on August 21, 2023, to remove the emergency affirmative defense provisions from the EPA’s Title V operating permit program regulations (40 CFR 70 and 40 CFR 71) and subsequently required permitting agencies to revise Title V programs. Updates to Rule 1101 – Title V – Federal Operating Permits complies with the EPA’s final rule by removing Emergency Provisions (Section 6.2.12) and the Emergency definition (Section 2.13).

 

The District will incorporate comments received into the proposed amended rule which will be published for public commenting in September 2025. Please see the attached Draft Staff Report and Draft Rule for more information.
